Forced Execution Mediation

Mediation can often intervene during the forced execution phase. Although the parties involved are in the conflict resolution phase, new episodes frequently occur, with unwanted emotional and material consequences.

According to the Code of Civil Procedure, throughout the forced execution, the creditor and the debtor can agree that it be carried out only on certain revenues or assets, or that payment be made in another way permitted by law.

Advantages for the Creditor

  • Avoiding high execution costs: Expenses for bailiffs and legal counsel are advanced by the creditor and often difficult to recover fully.
  • Certainty of recovery: Avoiding delays and the risk of prescription or termination of execution due to inactivity.
  • Amicable settlement: Reaching a voluntary agreement with the debtor with clear deadlines and sources.

Advantages for the Debtor

  • Negotiating a settlement: Finding a way to pay that least affects their activity (payment calendar).
  • Reducing costs: Avoiding the accumulated expenses of long-term execution procedures.
