Family Law Mediation

In the field of family relations, parties can use mediation to resolve disputes regarding the continuation of marriage, as well as minor aspects when children are involved: parental authority, joint custody plans, child support, and residence.

Spouses can use a mediator when a divorce is in progress or before starting it. In the first case, they will present the mediation agreement to the court. In the second case, they will file for divorce and attach the agreement regarding the accessory aspects.

Through mediation, former spouses can also decide on the division of common property. This offers a major financial advantage: court fees are reduced by half compared to court proceedings or notary voluntary divisions.

Normally, if spouses go directly to court for property division, the fee is 3% of the property's value. Using a mediator, the fee for the confirmation action is only 1.5%.

Advantages

  • Focusing on the child's best interest, minimizing the impact of separation;
  • Shorter resolution time compared to years of court trials;
  • Lower costs (reduced court fees and fewer expenses);
  • Confidentiality and private settings (avoiding public court hearings);
  • The solution belongs to the parties, not to a judge.
